Petitioner purchased a piece of land at Dehradun and he applied for permission to construct a commercial building thereupon. His application is rejected on the ground that the land is earmarked for community centre, therefore, the permission sought by the petitioner cannot be granted. Thus, feeling aggrieved, petitioner has approached this Court. 4. Mr. Rahul Consul, learned counsel appearing for Mussoorie Dehradun Development Authority submits that as per zonal development plan, a community centre has to be constructed over the land in question, therefore, the competent authority was justified in refusing permission to the petitioner. He, however, submits that if petitioner has any grievance, then he can approach the State Government for conversion of land use, by moving an appropriate application. 5. This Court finds substances in the said submission. Change of user can be permitted only by the State Government. 6. Thus, the writ petition is disposed of with liberty to the petitioner to approach the State Government, by moving application. Application, if made, shall be dealt with, as per law, within nine months of its making.
