Vide order dated 12.11.2024 passed by this Court, respondent no.2 was directed to appear in person before this Court, however, none appears for respondent no.2. It appears that respondent no.2 is not willing to go for mediation. Heard learned counsel for the revisionist and learned A.G.A. for respondent State. The present criminal revision has been filed by the revisionist for setting aside the impugned maintenance order dated 16.10.2024 passed by Principal Judge/Family Court, Bahraich in Case No.1021/11/2017 "Smt. Naimulnisha alias Naimul vs. Atik alias Lallu" thereby awarding maintenance of Rs.4000/- per month in favour of opposite party no.2. Perused the record. Perusal of the record shows that it is not in dispute that respondent no.2 is the legally wedded wife of the revisionist. She is a destitute and incapable of maintaining herself she has been deserted by revisionist after the marriage. The revisionist appears to have sufficient source of income. There appears to be no illegality in the order impugned. The revision, being devoid of merit, is accordingly dismissed.
