The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…..to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not up grading the petitioner as Grade -I Conductor and not promoting the petitioner as ADC on par with juniors to the petitioner is illegal, arbitrary and unjust and violation of Article 21 of Constitution of India, consequently direct the respondents to upgrade the petitioner as Grade I Conductor and promote the petitioner as 2 ADC on par with juniors as this Hon'ble Court may deem fit and proper in the circumstances of the case.” 2. Learned counsel for the petitioner would submit that the petitioner was called to submit his willingness for the promotion. He has submitted his willingness for the promotion to the post of ADC. The petitioner name was shown at Serial No.40 in the approved preparation of panel for promotion to the post of ADC vide orders dated 06.03.2025. Learned counsel would further submit that the petition may be disposed of recording the same. 3. In that view, the Writ Petition is disposed of. The respondent authorities are directed to consider the case of the petitioner according to governing rules and law. There shall be no order as to costs.
