Supplementary affidavit filed today is taken on record. 2. Heard learned counsel for the parties and perused the record. 3. The instant writ petition has been filed for following relief: "i) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no.2/ Up Ziladhikari, Tehsil Aurai, District Bhadohi to decide the appeal filed by the petitioner against the order dated 9.10.2024 passed by respondent no.3/ Naib Tehsildar, Tehsil Aurai, District Bhadohi in Case No. T202416670603920 Vijaikant Dubey and others Vs. Bholanath Dubey, Mauja Ugapur, under section 24 U.P. Revenue Code, 2006 in terms of judgment and order rendered by this Hon'ble Court dated 10.5.2024 on merit within specific period fixed by this Hon'ble Court." 4. Contention of the learned counsel for the petitioners is that the appeal against the order dated 9.10.2024 filed by the petitioners is pending before the respondent no.2. He prayed that the same may be decided expeditiously. 5. No useful purpose would be served in keeping this petition pending. 6. The present petition stands disposed of finally with a direction to the respondent No. 2, Up Ziladhikari, Tehsil-Aurai, District-Bhadohi to consider and decide the aforementioned appeal filed by the petitioner, in accordance with law, expeditiously, preferably within a period of four months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
