HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1435 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. 1. The present anticipatory bail application has been filed seeking anticipatory bail in CASE CRIME NO.: 843/2025, UNDER SECTIONS: 310(2), 317(3), 61(2), 351(3) OF BNS, POLICE STATION: KOTWALI, DISTRICT: BARABANKI. 2. In the prosecution case, it is alleged that negotiations were ongoing for the purchase of US dollars from Alok Singh. In this connection, Alok’s friends, namely Shahid, Ajaj, and Ram Sevak Yadav, are said to have met the informant. It is further alleged that on 30.08.2025, Shahid, Ajaj, and Ram Sevak Yadav called the complainant to Banali, Barabanki, along with an advance of Rs. 25,00,000/-. Accordingly, the complainant, accompanied by his friend Janendra Singh, reached the location with Rs. 25,00,000/-, where they allegedly met the accused persons, who then looted the entire cash at gunpoint. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated. He states that the applicant merely introduced Alok Singh to co-accused Ajaj and Shahid for the purpose of purchasing US dollars. It is a case of false implication. 4. Learned AGA, on the other hand, contends that it is not a case of false implication. It is submitted that there is a specific allegation in the FIR Versus Counsel for Applicant(s) : Abhishek Dwivedi, Avinash Chaturvedi, Shivam Dixit Counsel for Opposite Party(s) : G.A. Ramsevak Yadav .....Applicant(s) State Of U.P. Thru. Addl. Chief Prin. Secy. (Home) Deptt. Home Lok Bhawan Lko. U.P. And Another .....Opposite Party(s) against the applicant regarding looting of Rs. 25,00,000/- at gunpoint, which is supported by the confessional statements of the co-accused and corroborated by the recovery of Rs. 15,00,000/- from them. The regular bail application of the co-accused is still pending. It is argued that this is not a fit case for anticipatory bail and custodial interrogation of the applicant may be necessary. 5. Perused the record, so also the oral statements of the co-accused and the recovery memo, which reflects that a total of Rs. 15,00,000/- in cash, passbooks of Punjab National Bank and Punjab & Sindh Bank, Aadhar cards, and five mobile phones were recovered from the co-accused persons. The recovery of Rs. 15,00,000/- cannot be doubted. 6. Considering the gravity of the offence, the ongoing investigation, and the likelihood that custodial interrogation may be required, no case for grant of anticipatory bail is made out. 7. Accordingly, the anticipatory bail application is dismissed. October 7, 2025 R.C. NABAIL No. 1435 of 2025 2 (Karunesh Singh Pawar,J.)
