Criminal Miscellaneous Bail Application No. 5573/2025 Man Singh S/o Ganesharam, Aged About 55 Years, R/o Nizampur, Police Station Nizampur, District Mahendragarh, Haryana. (At Present In Sub Jail, Khetri). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Vijayant Nirwan For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 18/08/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.62/2024 registered at Police Station Pacherikalan, District Jhunjhunu for the offence(s) under Section 302 of IPC.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is alleged against the petitioner and other co-accused Manju Devi that they conspired with each other and caused murder of the deceased Bhanaram. The prosecution also alleges that the deceased Bhanaram was having affair with her daughter-in-law i.e. Manju Devi and thereafter Manju Devi developed affair with the accused-petitioner Man Singh, when the deceased came to know about the said fact, he restrained the co-accused Manju Devi
[2025:RJ-JP:32057] (2 of 4) [CRLMB-5573/2025] to meet the petitioner. It is also contended that the prosecution has failed to establish any motive behind the death of deceased Bhanaram. The prosecution case entirely rests upon the circumstantial evidence. There is no last seen evidence that soon before or after causing death of Bhanaram, the petitioner Man Singh was seen with the other absconded co-accused Amit. There is no evidence to the fact that at the place of occurrence, the presence of the petitioner was found. The prosecution has not collected any incriminating evidence connecting the petitioner in death of the deceased Bhanaram. Admittedly, Bhanaram died due to gun shot injury but no weapon/gun was recovered at the instance of the present petitioner. There is no evidence on the record to show that petitioner Man Singh and co-accused Manju Devi were having love affair and they used to meet at regular intervals. It is also contended that apart from the recovery of motorcycle, allegedly used in commission of crime at the instance of the petitioner and verification of place of occurrence, there is no evidence on record to show the petitioner's involvement in the alleged crime. It is further contended that the name of the petitioner is not mentioned in the FIR. The statement of the relatives of deceased Bhanaram i.e. his son PW-1 Rohitash, grandson PW-4 Abhishek and daughter-in-law PW-11 Suman Devi have been recorded and they have turned hostile and denied the fact that they saw the petitioner with other co-accused Manju Devi. The other co-accused Manju Devi has also enlarged on bail. The petitioner is in custody since 11.04.2024 and trial of the case
[2025:RJ-JP:32057] (3 of 4) [CRLMB-5573/2025] may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3.
Learned Public Prosecutor has vehemently opposed the bail application and contended that the deceased was murdered by the petitioner in connivance with co-accused Manju Devi. At the instance of the petitioner, a motorcycle was recovered, which was used for commission of crime, therefore, considering the gravity of the offence, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. The prosecution case revolves around the circumstantial evidence. Admittedly, there is no evidence to the fact that the petitioner was seen soon before or after commission of crime with the deceased. There is no evidence on the record to show that deceased Bhanaram was having illicit relationship with his daughter-in-law i.e. co-accused Manju Devi. The statement of close relatives of deceased Bhanaram have already been recorded and they denied the fact that co-accused Manju Devi was having illicit relationship with the petitioner. The petitioner is in custody since 11.04.2024 and trial of the case may take considerable time, therefore, considering the arguments advanced by learned counsel for the petitioner and after going through the material placed on record, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Man Singh S/o Ganesharam, in connection with FIR No.62/2024 registered
[2025:RJ-JP:32057] (4 of 4) [CRLMB-5573/2025] at Police Station Pacherikalan, District Jhunjhunu, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
