Singh Royekwar, learned Counsel appearing on behalf of the respondent no.2 and Sri D.K. Singh Chauhan, learned Counsel appearing on behalf of the respondent no.4. 2. The present petition has been filed challenging the orders whereby, the request of the petitioners for grant of D. Pharm. (Diploma in Pharmacy) approval has been rejected. 3. It is stated by the Counsel for the petitioners that the petitioners no. 1 and 2 have already preferred an appeal which is pending before the appellate authority of the respondent no.3. The petitioner no.3 had not filed the appeal. 4. Considering the fact that the petitioners no.1 and 2 have already filed appeals and the right of appeal is available to the petitioner no.3, the present petition is disposed off with direction to the appellate authority to pass orders on the application filed by the petitioners within the time line as fixed by the Hon'ble Supreme Court in the case of Parshavanath Charitable Trust & Ors. vs All India Council for Technical Education & Ors (Civil Appeal No.90448 of 2012) and in accordance with law. While doing so, the judgment of this Court in the case of C/M Karmyog Sewa Samiti through Authorized Signatory Sri Rajendra Kumar Soni vs Versus Counsel for Petitioner(s) : Gopal Pandey Counsel for Respondent(s) : C.S.C. Institute Applied Pharmaceuticals Science Chapiya Sarkari Thru. Chairman And 2 Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Technical Education Lko.
