_ ...'=- The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity fthe BNSSJ), seeking to enlarge the petitioner/Accused Nos.2 to 5 on bail in Cr.No.38 of 2025 of Golugunda Police Station, Anakapalli District, registered against the petitioners/Accused herein for the offence punishable under Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and- psychotropic substances Act, 1985 (for brevity {the NDPS ActI). 2. The case of the prosecution in nutshell is that on ll.04.2025 the Sub-Inspector of Police, Golugonda Police Station, received information about the illegal possession and transportation of ganja and he secured the presence of mediators and rushed to outskirts of Golugonda village, where he noticed one Toyoto Etios vehicle coming from K.D. Peta side to Narsipatnam side and on seeing the police, the driver tried to escape by reversing the vehicle.
The Sub-Inspector of Police along with his staff apprehended four persons from the vehicle and seized 1 kg of Hash Oil from their possession under the cover of mediators report. i, t\1 \`
3. Heard learned counsel for the petitioners and the learned AssI-Slant Public Prosecutor. Perused the record. 4. Sri. G.Maheswara Rao, the learned counsel for the petitioners submits that the petitioners have not committed any offence; petitioners were falsely implicated by the police in the crime; petitioner are the sole breadwinners; petitioners would abide by any conditions to be imposed by this Court; and urged to allow the pe{i{ion. 5. Per cot,fra, Ms.P. Akila Naidu, the learned Assistant Public Prosecutor, opposed the bail application stating that the petitioners are habitual offenders, some more material witnesses have to be examI-ned; investigation iS not completed; if the petitioners are enlarged on bail, they would not be available for the investigation and they would escape from the clutches of law; and urged to dismiss the bail petition. 6. As seen from the record, the petitioners have been in the judicial custody since ll.04.2025. The petitioners are residents of Rangasamudram, Porumamilla Mandal, Kadapa District of Andhra Pradesh. lf the petitioners are enlarged on bail with

Keeping in view of the period of detention undergone by the petI'tiOners in judicial custody for more than 45 days, the nature and gravity of allegation levelled against the petitioners, and their alleged role in the case, this court is inclined to enlarge the petitioners on bail with the following stringent condI-lions. 8. ln the result, the criminal petition is allowed wI'th the following condI'tiOnS: i.
