Mr. Siddhartha Sah, learned counsel for the petitioner. 2. Mr. Siddharth Jain, learned counsel for the respondent-Bank. 3. Petitioner is a borrower, who defaulted in repayment of loan. The Bank has issue e-auction notice by invoking its power under SARFAESI Act, 2002. Petitioner has approached this Court seeking the following reliefs: - (i) Issue a writ, order or direction in the nature of certiorari to quash the e-auction/ sale notice dated 4/ 11/ 2025 issued by the Indian Overseas Bank, Branch Chowk Bazar, Kankhal, District Haridwar through it’s Authorised Officer, (Contained in Annexure no. 4 to this writ petition). (ii) Issue a writ, order of direction in the nature of mandamus commanding the respondent Indian Overseas Bank to consider the Restructuring request of the petitioner as per provisions of MSME Revival and Rehabilitation Framework Instructions and Directions, 2016. 4. This Court finds substance in the submission made by learned counsel appearing for Indian Overseas Bank that petitioner has remedy of approaching Debts Recovery Tribunal under Section 17 of SARFAESI Act. 5. Accordingly, the writ petition is disposed of with liberty to petitioner to approach the appropriate forum.
