HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 9360 of 2025 Court No. - 10 HON'BLE RAJNISH KUMAR, J. HON'BLE ZAFEER AHMAD, J. Heard learned counsel for the petitioner and learned A.G.A. for the State. By means of this writ petition, the petitioner has prayed for quashing the FIR dated 31.7.2025 registered as case crime no. 0252 of 2025 under Sections 3(2)(Va), 3(1)(Gha), 3(1)(Da), 351(3), 109(1), 115(2), 118(1), 352, 3(5) I.P.C., police station Jaidpur, district Barabanki. Learned counsel for the petitioner submits that the petitioner has wrongly be implicated in the impugned F.I.R. on the basis of concocted story whereas the petitioner is innocent. As per injury report, the injured has received as many as five injuries. Learned A.G.A. has opposed the submissions of learned counsel for the petitioner. Having considered the submissions of learned counsel for the parties and on perusal of record as well as contents of the F.I.R, the commissioning of offence cannot be ruled out. Thus, no case for interference is made out in view of law laid down by the Hon'ble Supreme Court in the case of State of Telangana Vs. Habib Abdullah Jellani;(2017)2 SCC 779 and Neeharika Infrastructure Pvt. Ltd. Vs. State of Maharashtra and Others; (2021) SCC Online SC 315. The writ petition is accordingly dismissed.
