Order
[2025:RJ-JP:2432] (2 of 2) [WRW-97/2023] 17/01/2025
1. Both the review petitions have been submitted by the rival sides for recalling of the order dated 10.03.2023 passed by this Court, while deciding S.B. Civil Writ Petition No.701/2020.
2.
Learned counsel for the parties submits that important questions of law were involved in the said petition, but the counsels could not appear because of the suspension of work called by the Bar Association. Counsel submits that at the time of passing of the order dated 10.03.2023, the petitioner and the Officer-Incharge appeared in-person and they could not apprise the proper facts and the issue of law involved in this petition and in absence thereof, the order dated 10.03.2023 has been passed. Counsel submits that the matter requires to be heard and decided on its merit on the basis of facts and question of law involved. Hence the order dated 10.03.2023 be recalled.
3. Considering the arguments put forward by the learned counsel for the parties, the order dated 10.03.2023 stands recalled and both the review petitions stand allowed. S.B. Civil Writ Petition No.701/2020 is restored to its original number.
4. Office is directed to proceed.
