Notice on behalf of respondent no.1 has been accepted by the office of Chief Standing counsel and Sri Virendra Mishra learned counsel has put in appearance on behalf of respondent no.2. Learned counsel for the petitioner, at the outset, states that he confines his submission only to the prayer (a) i.e. to decide the revision preferred under Section 41(3) of the Urban Planning and Development Act, 1973 read with Section 12 of the U.P. Industrial Area Development Act, 1976 and he does not propose to press his prayer (b). He is permitted to delete the same during course of the day. Sri Hemant Pandey and Sri Virendra Mishra learned counsel for the respondent nos.1 and 2 respectively submits that in so far as prayer for expedition is concerned, they have no objection. Considering the fact that the prayer is only for expedition of the revision pending before the respondent no.1, the petition is disposed of with a direction that the revision shall be considered and decided within a period of eight weeks from the date certified copy of this order is placed before the authority concerned. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law.
