HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9528 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.89 of 2025, under Section 191(2), 103, 123, 61(2)(A) of BNS, P.S. Rampur Kalan, District Sitapur. 3. The FIR in question was lodged alleging that a land dispute is going on in a Court of law and the same was being attended to while the opposite parties became inimical on account of the said case and they had killed the brother of the informant after throttling and administering some poisonous substance. 4. In the light of the said allegation, my attention is drawn towards the postmortem report which does not indicate any injury on the body of the deceased especially on the neck region. My attention is also drawn to the FSL report which indicates the presence of aluminium phosphide in the viscera. In the light of the said, it is argued that on account of land dispute, the applicant is being falsely implicated in the offence in question. 5. Learned AGA has opposed the bail application. 6. Considering the postmortem report and the FSL report, prima-facie, linking of the applicant with the offence under Section 103 BNS is not made Versus Counsel for Applicant(s) : Nalin Arora, Anubhav Singh, Ashish Anand Counsel for Opposite Party(s) : G.A.
