Present applicant– Afjal S/ o Ikbal is seeking regular bail in relation to first information report dated 07.03.2025 bearing FIR No. 0095 of 2025, Police Station Kashipur, District Udham Singh Nagar, wherein the present applicant along with Ibrahim, Iqbal and Afzaal have been implicated for the offences punishable under Sections 3 and 11 of the The Uttarakhand Protection of Cow Progeny Act, 2007 and Section 11 of the Prevention of Cruelty to Animals Act, 1960 read with Section 109 of BNS, 2023 and 3/ 25 of the Arms Act, 1960. 4. Learned counsel for the applicant submits that the present applicant is innocent and has been falsely implicated, and, furthermore, there is no independent witness, and the recovery, as shown, is planted one. 5. Learned counsel for the applicant also submits that one of the co-accused Ibrahim has already been enlarged on bail and the present applicant claims parity. 6. On the other side, Mr. Himanshu Sain, learned Brief Holder for the State have not disputed this fact that the other co-accused Ibrahim has already been granted bail and he fairly submits that the role of present applicant is identical to Ibrahim and deserves for the parity of the other co-accused. 7. After hearing the arguments as advanced by learned counsel for the parties and further taking into consideration that the applicant has no 2025:UHC:11056 previous criminal history and the other co- accused Ibrahim has already been enlarged on bail, this Court is of the view that the applicant deserve for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the present bail application is allowed. 9. Let the applicant, namely, Afjal, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
