Learned counsel for the applicant submits that WP(S) No.6261/2021 was dismissed on 16.01.2024 on account of peremptory order dated 12.12.2023 as applicant/petitioner failed to make good the default. He further submits that since counsel of applicant was out of station at the relevant point of time, as such, he could not rectify the default and it was also not informed to the applicant/petitioner, hence it is prayed that, the instant MCC may be allowed and WPS No.6261/2021 be restored to its original number. 4. Learned counsel for the respondents have no objection to allow the prayer made by learned counsel for the applicant. 5. On due consideration and for the reasons assigned in the memo of MCC, the same is allowed. The Registry is directed to restore WP(S) No.6261/2021 in its original number. 6.
