Saha is present for the petitioners. Learned P.P., Mr. R. Datta is present for the State- respondent. This petition under Section 397 of the Code of the Criminal Procedure, 1973 read with Section 401 of the Code of the Criminal Procedure, 1973 is filed challenging the order dated 02.12.2025 passed by the Learned Special Judge (NDPS), Dhalai District, Ambassa, Tripura in connection with Special (NDPS) 16 of 022. At this stage, Learned P.P. drawn the attention of the Court that this present petition is not maintainable as because by the impugned order, Warrant of Arrest has been issued against all the accused persons i.e. the present petitioners and 3 (three) others and also an order is passed for drawing up of separate proceeding under Section 446 of Cr.P.C. So, in such a situation, according to Learned P.P., the petition for exercising revisional jurisdiction by this High Court is not maintainable. Learned Senior Counsel, Mr. S. Sarkar drawn the attention of this Court that he is not willing to proceed further with this matter and submitted to withdraw the petition with liberty to file afresh petition under Section 528 of BNSS, claiming appropriate relief. Request is considered. Hence, this petition stands disposed of being not pressed by the petitioners with a liberty to file appropriate petition if they are so advised.
