1. Mr. M.S. Pal, learned senior counsel assisted by Ms. Amreen Bano, learned counsel for the applicant. 2. Mr. G.S. Sandhu, learned Additional Advocate General with Mr. Himanshu Sain, learned Brief Holder for the State. 3. The present applicant ‘Shahid Ali’ S/o Alisher is praying for bail in reference to First Information Report dated 04.03.2025 bearing FIR No. 0110 of 2025 P.S. SIDCUL, District Haridwar, wherein, the present applicant along with one Dharmendra have been implicated for the offences punishable under Sections 8/21 r/w Section 60 of NDPS Act. 4. The First Bail Application was rejected on 19.05.2023 and thereafter the Second Bail Application was rejected on 30.07.2023. Earlier bail applications were rejected on the ground that the applicant have a criminal history of four cases relating to the same nature of allegations. Now, the third bail application has been moved by the present applicant on the ground that the charge- sheet has already been filed and the present applicant is languishing in jail since 04.03.2025 and the other co-accused Dharmendra have already been granted bail and so far as the previous cases are concerned the applicant has already been enlarged on bail. 5. He further submits that the alleged contraband, which is shown to be recovered from the present applicant, is non-commercial quantity i.e. 48.39 gms of smack. 6. On the other side Mr. Sandhu have not disputed that the charge-sheet has already been field and the other co-accused has already been enlarged on bail and the present applicant is languishing in jail since 04.03.2025; however, he submits that since the present applicant is habitual offender since earlier he was involved in four
2025:UHC:11002 cases of similar nature, therefore, some stringent conditions may also be imposed. 7. After hearing the arguments of learned counsel for the parties and taking into consideration that charge-sheet has been filed and other co-accused has already been enlarged on bail and in previous cases the applicant is already bailed out, this court is of the view the applicant deserves for bail. 8.
Accordingly, without expressing any opinion on the merit of the case the third bail application is allowed. 9. Let the applicant ‘Shahid Ali’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned. 10. It is made clear that after being released on bail the applicant shall report to the nearest police station on the first day of every month and the concerned SHO shall record his presence, failing which the prosecution is free to move an application for cancellation of bail and furthermore after being released the applicant shall appear before the Trial Court proceeding on each and every date without seeking any unnecessary adjournment.
