[2025:RJ-JP:28348] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 6467/2025 Sitaram Mesariya Son Of Sh. Bhanwar Lal Mesariya, Aged About 36 Years, Resident Of Village Ilahipura Urf Hazipura, Peeplu, District Tonk. ----Petitioner Versus
1. State Of Rajasthan, Through The Principal Secretary, Department Of Higher Education, Secretariat, Jaipur. 2. Commissioner, College Education, Siksha Sankul, J.l.n. Marg, Jaipur. 3. Principal, Lal Bahadur Shashtri Government College, Kotputli, District Kotputli- Behror. 4. Principal, Government College, Banipark, Jaipur. ----Respondents For Petitioner(s) : None present For Respondent(s) :
HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Order 28/07/2025 On last date, i.e., 25.07.2025, following order was passed:-
“In the first round, learned counsel for the petitioner appeared and prayed for adjournment. When, this Court expressed its prima facie opinion that the writ petition is not maintainable as no cause of action has arisen to the petitioner, he prayed the matter to be passed over. In the second round, none appears for him. However, in the interest of justice, he is granted one more opportunity to present his case. [2025:RJ-JP:28348] (2 of 3) [CW-6467/2025] List the matter on 28.07.2025 at top of the list.” Today, none appears for the petitioner even in the second round. This writ petition is filed seeking a direction to the respondents not to dislodge/disengage the petitioner as guest faculty in the academic session 2024-25 pursuant to advertisement dated 10.02.2025 with a further direction to them to give him preference for re-engagement. It is stated in the memo of the writ petition that the petitioner was engaged as guest faculty by the Government College, Banipark, Jaipur in the year 2024 in the History Department on honorarium @ Rs.8,00/- per period and is continuing as such till date. It is averred that the Principal, Lal Bahadur Shastri Government College, Kotputli has issued an advertisement dated 10.02.2025 inviting applications for fresh appointment as guest faculty in the Jhunjhunu District for the academic sessions 2024-25. Expressing apprehension that he may be dislodged or may not be re-engaged under the fresh advertisement dated 06.02.2025, this writ petition is filed. In the writ petition, it is stated that the petitioner was engaged as guest faculty by the Government College, Banipark, Jaipur where, he is working till date and to substantiate this plea, a copy of the statement of bank account of the petitioner has been placed on record.
However, it is for the period form 22.01.2025 to 15.02.2025 and does not evident that the petitioner is still working as guest faculty. Further, alongwith the memo of the writ petition, a web copy of the advertisement dated 10.02.2025 has
[2025:RJ-JP:28348] (3 of 3) [CW-6467/2025] been enclosed which has been issued by the Lal Bahadur Shastri Government College, Kotputli and does not pertain to the College where the petitioner is alleged to be engaged as guest faculty. Moreover, it is alleged in the writ petition that the advertisement dated 06.02.2025 has given him an apprehension of his dislodging but, no such advertisement is part of the writ petition. In the aforesaid circumstances, it is apparent that this writ petition is wholly misconceived and frivolous. Resultantly, this civil writ petition dismissed. Pending application(s), if any, also stands disposed of. (MAHENDAR KUMAR GOYAL),J Manish/s-378
