Direct the Respondent No.2 not to harass the Petitioner in the inquiry and without due process of law with respect to the complaint lodged by one Ujwala; B. Pass any such other order(s) as this Hon’ble Court may deem fit in the facts and circumstances of the case in the ends of justice. 2. Heard learned counsel for the petitioner and learned HCGP for the respondents and perused the material on record. - 3 - NC: 2025:KHC:6837 WP No. 4233 of 2025 3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner submits that during the period from 19.01.2025 to 28.01.2025, one Ujwala said to have lodged a compliant against the petitioner, which is culminated in NCR. It is submitted that despite the closure of the case by issuance of NCR in relation to the complaint given by the aforesaid Ujwala, the respondents are unnecessarily harassing, intimidating and annoying the petitioner and repeatedly asking the petitioner and his parents to come to the police station and as such, the petitioner is before this Court by way of the present petition. 4. Per contra, learned Addl. SPP submits that the respondent-Police will not proceed against the petitioner or his parents except in accordance with law and bearing in mind the principles laid down by the Apex Court in the case of LALITA KUMARI vs. GOVERNMENT OF UTTAR PRADESH AND OTHERS reported in (2014) 2 SCC 1 and shall not harass, intimidate and annoy the petitioner or his parents in any manner. In view of the aforesaid facts and circumstances and submission made by both side, I deem it just and proper to dispose of this petition directing the respondents-Police Authorities not to harass, intimidate and annoy the petitioner or his parents in any manner whatsoever. However, liberty is reserved in favour of the respondents-police Authorities to take action against the petitioner in accordance with law bearing in mind the principles laid down by the Apex Court in LALITA KUMARI’s case (supra).
