Heard learned counsel for the petitioner, learned Standing Counsel, who appears on behalf of the State- opposite parties no.1 and 2 and Sri Ram Kumar Singh, who appears on behalf of opposite parties no.3 and 4. 2. In view of the order proposed to be passed, issuance of notice to opposite party no.5 is dispensed with. 3. This writ petition has been filed with the following main prayer:- "i) issue a writ, order or direction in the nature of mandamus commanding the opposite party no.1 that he take the appropriate action against the Chairman, Nagar Panchayat, Belhara, District Barabanki in the light of explanation notice dated 27.08.2024 issued by Nagar Vikas Anubhag-1, Government of U.P., contained as Annexure No.2 within reasonable time, in the interest of justice.” 4. A preliminary objection has been raised by the learned Standing Counsel that petitioner is not a person aggrieved. She has no locus to file this writ petition as there is no statutory right of the petitioner nor any corresponding duty of opposite party no.1 to take action against opposite party no.3.
