Learned counsel for the applicant has submitted that the present applicant has been falsely implicated in the case as he has not committed any offence as alleged. Attention has been drawn towards the impugned FIR wherein the date of incident has been mentioned as 29.07.2024 but the FIR was lodged on 31.07.2024 without explaining the delay of two days. The FIR was lodged against two unknown persons as the antecedents and whereabouts of the accused was not known to the complainant at the time of lodging of the FIR and during the course of incident complicity of the present applicant was found, therefore, the chargesheet has been filed only against the present applicant. Further attention has been drawn towards the supplementary affidavit dated 15.07.2024 showing the statement of P.W.-1/complainant and P.W.-2/victim. Learned Counsel for the applicant submits that both the aforesaid witnesses are star witnesses and both have turned hostile while recording their chief examination and cross examination and both have denied the prosecution story and have stated that they have not levelled any allegation against the present applicant and have given their statements under Sections 180 & 183 B.N.S.S. under the pressure of the police. 4. Learned A.G.A. and learned counsel for the complainant have, however, opposed the bail application but they could not dispute the aforesaid submissions of learned counsel for the applicant. 6. Without entering into merits of the issue; considering the arguments of learned counsel for the parties; the fact that supplementary affidavit dated 15.07.2024 has been filed showing the statement of P.W.-1/complainant and P.W.-2/victim and both the aforesaid witnesses are star witnesses and both have turned hostile while recording their chief examination and cross examination and both have denied the prosecution story and have stated that they have not levelled any allegation against the present applicant and have given their statements under Sections 180 & 183 B.N.S.S. under the pressure of the police; the applicant is having no prior criminal history of any kind whatsoever and undertaking of the applicant that he shall cooperate in the trial proceedings and shall not misuse the liberty of bail, I find it appropriate to release the applicant on bail. 7. Accordingly, the bail application is allowed. 8. Let applicant- Neeraj Trivedi @ Shashank Trivedi be released on bail in the aforesaid case crime number on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:- (i) The applicant shall file an undertaking to the effect that he shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. (ii) The applicant shall remain present before the trial court on each date fixed, either personally or through his counsel.
