GP FOR HOME 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 14802 of 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ, order or direction more particularly one in nature of Writ of Mandamus, declaring the investigation done by the 3rd respondent through proceedings C.No.5670 / A7 / 2020, dated 07-08-2020 in reference to Endorsement N.Dis.No.791 / C2 / 2020, dated 13-06-2020 of the Inspector General of Police, South Coastal Zone, Guntur Range, Guntur is illegal, violative of principles of natural justice and violative of fundamental principles enshrined in the Constitution and consequently set aside and declare it as void the investigation allegedly done by the 3rd respondent C.No.5670 / A7 / 2020, dated 07-08-2020 and direct the 2nd respondent himself to investigate into the matter as per the G.O.Ms.No.288 / 2010 and pass such other order or.…” 2. None represented for the petitioner. 3. Sri V.Farooq, learned Assistant Government Pleader for Home on written instructions, would submit that the petitioner has been approaching the police officials with a request to initiate criminal action against the persons with whom he got disputes concerning the house property. He would further submit that in respect of the complaint dated 10.06.2020, the 4th respondent herein enquired into the matter transparently and submitted his report to the 2nd respondent through proper channel on 20.07.2020. He would further submit that they have only conducted enquiry on the issues raised by the petitioner. 3 4. For ready reference, the relevant portion of the written instructions is extracted hereunder: “It is submitted that since then, the petitioner herein has been approaching the police officials, with a request to initiate criminal action against the persons with whom he got the disputes concerning the house property. As the respondent police did not interfere in the said matters, he raised false allegations against the respondent police that they have been interfering in civil disputes. It is submitted that in respect of the complaint dated 10.06.2020, the 4th respondent herein enquired into the matter transparently and submitted his report to the 2nd respondent through proper channel on 20.07.2020. Presently, the same is pending before the 2nd respondent. I submit that the allegation of the petitioner that the investigation done by the 3rd respondent through proceedings dated 07.08.2020 in reference to endorsement in Dis. No. 791/C2/2020 dated 13.06.2020 of the Inspector General of Police, South Coastal Zone, Guntur Range, Guntur is quite misconceived as it is not an investigation as alleged by the petitioner. It is only an enquiry conducted while addressing the issue raised by the petitioner submitted to the 2nd respondent. The petitioner has got no right to question the enquiry report.” 5. Recording the same, the Writ Petition is disposed of. There shall be no order as to costs.
