[2025:JHHC:19123] IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No.5558 of 2025 ------ Bikash Kumar Mandal @ Vikash Kumar Mandal, aged about 31 years, son of Binay Mandal, resident of village Kharagdiha, P.O. & P.S.: Mohanpur, Dist: Deoghar. .... .... …. Petitioner Versus The State of Jharkhand .... .... .... Opposite Party ------ CORAM : HON'BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Mahesh Tewari, Advocate For the State : Mrs. Mohua Palit, Addl.P.P ------ Order No.02 Dated-14-07-2025 Heard the parties. The petitioner has been made accused in connection with Rikhiya P.S. Case No.222 of 2023 (S.T. Case No.157 of 2024) registered for the offence punishable under Section 302/120B/34 of the Indian Penal Code. This is the second journey of the petitioner for regular bail. Earlier the prayer for regular bail of the petitioner was rejected vide order dated 26.07.2024 passed in B.A. No.4984 of 2024. Learned counsel for the petitioner submits that the fresh ground is that the main witness of the prosecution who is the minor son of the deceased has been examined but he has supported the case of the prosecution. It is next submitted that the allegation against the petitioner is false. It is then submitted that the so far, five witnesses have been examined in this case during the trial. It is then submitted that the petitioner has been in custody since 08.12.2023 as is evident from para-12 of the instant bail application. Hence, it is submitted that the petitioner be released on bail. Learned Addl.P.P. appearing for the State on the other hand opposes the prayer for bail of the petitioner and submits that keeping in view the serious nature of allegation against the petitioner that he has killed his own wife and his own minor son is the witness, there is every chance of the petitioner causing harm to his own minor son, who has deposed against the petitioner in the trial, if released on bail and there is also chance of the petitioner absconding. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner and chance of his absconding, if released on bail, this Court is not inclined to admit the above named petitioner to bail. Accordingly, the prayer for bail of the above named petitioner is rejected. (Anil Kumar Choudhary, J.) Saroj/
