HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 9704 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE PRASHANT KUMAR, J. 1. Heard learned counsel for the parties. 2. This writ petition has been filed under Article 226 of the Constitution of India assailing order dated 18.02.2025, whereby application of the petitioner for claim made under 'Mukhyamantri Krishak Durghatna Kalyan Yojna' has been rejected by the respondent authorities. 3. The reason provided in the impugned order is that the petitioner's wife was not the bread earner, and accordingly, the claim would not fall within the parameters of 'Mukhyamantri Krishak Durghatna Kalyan Yojna'. 4. Upon perusal of the documents annexed to the writ petition, we find that the petitioner's wife was working in the fields as 'bataidar'. This fact has been buttressed by an affidavit filed by the person, on whose fields the petitioner's wife was engaged as 'bataidar'. 5. In view of above, we are of the view that the impugned order is perverse and based on extraneous reasons that are not supported by the actual facts in existence. 6. In light of above, impugned order dated 18.02.2025 is quashed and set aside with direction to the authorities concerned to grant an opportunity of hearing to the petitioner as well as for providing additional documents, if Versus Counsel for Petitioner(s) : Kalika Prasad Pandey, Sandeep Kumar Pandey Counsel for Respondent(s) : C.S.C. Putti Lal .....Petitioner(s) State Of U.P. Thru. Commissioner And Secy. Board Of Revenue Lko. And 2 Others .....Respondent(s) any, and thereafter pass reasoned order in accordance with law within six weeks from the date. 7. With the above directions, writ petition is disposed of.
