2025:JHHC:17297 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 3455 of 2025 ----- Vijay Ram, S/o Late Darshan Ram, R/o Village Chinia, P.O. & P.S. Chinia and District- Garhwa .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Rishi Pallava, Advocate For the State : Mr. Shree Prakash Jha, AddI. P.P. …...... 04/ 01.07.2025: Heard, learned counsel for the parties. 2. This is an application filed by the petitioner praying for grant of anticipatory bail under Sections 482 & 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 126(2), 115(2), 118(1), 325, 109, 3(5) of B.N.S. in connection with Garhwa Nagar P.S. Case No.668 of 2024, pending in the Court of learned Chief Judicial Magistrate, Garhwa. 3. I find that there is an allegation of assault upon the informant by this petitioner. Since there is an allegation of assault, I am not inclined to grant anticipatory bail to the petitioner. 4. However, if the petitioner appears before the concerned Court, the Court will consider whether on the facts of this case, nature of injury and the medical report Section 109 of BNS is attracted in this case or not and thereafter, considering the same will pass an appropriate order. 5. Accordingly, the instant anticipatory bail application stands disposed of. (ANANDA SEN, J.) R.S./
