(Oral) Petitioner, who is working as a Peon at GSSS Tikru, District Chamba has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his representation (Annexure P-2), in a time bound manner, wherein he has prayed for his transfer from present place of posting to GHS Mundah u/c GMSSS Saloni, District Chamba, HP, against vacant post. 2. It is averred in the petition that petitioner is 40% visually impaired and Clause 5.3 of CGP-2013 provides for adjustment of a person with benchmark disability of 40% or above, at a station near to his native place, as such, petitioner has prayed to respondent No.2 by way of representation, for his 2025:HHC:18138 transfer at aforesaid place. Since, representation of the petitioner has not been decided till date, he has approached this Court. 3. Notice. 4. Mr. Rajan Kahol, learned Additional Advocate General accepts notice on behalf of the respondent. He states that the aforesaid representation of the petitioner shall be decided expeditiously, in accordance with law. 5. Without going into merits of the case, present petition is disposed of by directing respondent No.2 to consider and decide representation (Annexure P-2) filed by petitioner, expeditiously, preferably within three weeks from today, after giving opportunity of hearing to the petitioner and by passing a speaking order, taking note of clause 5.3 of CGP-2013, which shall be communicated to the petitioner. Liberty is reserved to the petitioner to approach competent court of law, if he still remains aggrieved. Till the time, representation is decided by respondent No.2, post of Peon at GHS Mundah u/c GMSSS Saloni, District Chamba, HP, shall not be filled up. Petition stands disposed of in the afore terms.
