ORDER:- HONJBLE SRI JUSTICE K.SURESH REDDY CRL.P.NO.4786 OF 2025 +. Accused No.2 in Crime No.212 of 2025 of Prohibition and Excise Police Station, Rajamanhendravaram South, East Godavari District, filed the present Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha sanhita, 2023 (for brevity lthe BNSS') seeking ''pre-arrest bail. The above crime was registered against the petitioner herein for the offence under Sections 7(B) r/w. 8(A) and 8(c) of A.P Prohibition (Amendment) Act, 2020 and CUR Regulation of Use Order,1968. 2. The case of the prosecution is that the petitioner is running a business under the name and style of R.Harini Eswari Kirana and General Store in front of Primary Agricultural Co-operative Society in Bhupalapatnam Village of Rajanagaram Mandal. The allegation against the petitioner is that Accused No.1 purchased jaggery for the purpose of manufacturing ID liquor from the petitioner. When Accused No.1 was manufacturing the lD liquor, the Excise officials apprehended him and found 600 liters of FJ wash. During the course of investigation, Accused No.1 made a confession stating that he purchased the jaggery from the shop of Accused No.2. On the said allegation, the present Crime has been registered against the petitioner/Accused No.2. 3. As seen from the record, there is no ban for selling the jaggery and the petitioner has no control over the persons who purchased the jaggery 4? cF}nd ¥

As such, thi_s Court is inclined to grant pre-arrest bail to the f/ petitioner with certain conditions:- (i) The petitioner shall surrender before the station House Officer, Prohibition and Excise Police Station, RaJ'amahendraVaram South, East Godavari District on or before 05.06.2025. (ii) On such surrender, the prohibition and Excise Police Station, Rajamahendravaram South, is directed to release the petitioner on bail on his furnishing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. (iii) On release, the petitioner shall appear before the Station House Officer concerned, once jn a week i.e. on every Monday between 10.00 a.m. and 01.00 p.m., until further orders. (iv) On such release, the petitioner shall cooperate with the investigation and he shall not to tamper with the prosecution witnesses. 4.
