By means of the instant petition filed under Section 24 C.P.C., the petitioner seeks transfer of proceedings bearing R.S. No. 795 of 2023 under Section 13 of the Hindu Marriage Act pending before the Principal Judge, Family Court, Etawah to the appropriate Court, Lucknow. This Court finds that in light of the law laid down by this Court in Vivek Raj Singh vs Civil Judge Junior Division Tilhar Shahjahanpur and another reported in 2022 SCC Online All 1841, the instant petition is not maintainable before this Court as the proceedings of which transfer has been sought is pending in Allahabad. Admittedly, District Etawah does not lie within notified area of Oudh. Accordingly, this Court is clear that this petition is not maintainable at Lucknow having jurisdiction at Allahabad. It will be open for the petitioner to file a petition at the appropriate Court at Allahabad. With the aforesaid liberty, the petition is dismissed.
