1. The applicant has preferred this second bail application under Section 483 of Bharatiya Nagrik Suraksha Sanhita 2023 for grant of regular bail as he has been arrested on 31-1-2024 in connection with Crime No. 10 of 2024 registered at Police Station –
2 Amlipadar, District Gariyaband (CG) for alleged commission of offences under Sections 363, 366, and 376(2)(n) of IPC, Sections 4 & 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Earlier first bail application of the applicant was dismissed as withdrawn vide order dated 12-9- 2024 passed in MCRC No 4167 of 2024 with liberty to revive the same after material witnesses are examined.
2. In pursuance of the direction earlier given by this Court, father of the victim has appeared before this Court through video conferencing and raised objection in releasing the applicant on bail and his objection is taken on record.
3. Learned counsel, for the applicant would submit that he seeks permission of this Court to withdraw this bail petition with a prayer that a direction may be given to the trial court to expedite the trial.
4. This Court sought information regarding status of the trial of this case whereby it has been informed that the trial Court has issued warrant against the witness who is a woman for her appearance before the trial Court.
5. Considering the fact that the trial Court is proceeding in the matter by taking recourse available to it and also considering the fact that the applicant is in jail since 31-1-2024, it is directed that the trial Court shall conclude the trial expeditiously.
6. With the aforesaid observation and direction, the instant MCRC is
disposed of. Sd/-
