A case has been registered against the petitioner herein and another for the offences punishable under Sections 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 and Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act,1985 (for short [the NDPS Act'). 3. Brief facts of the case are that, on o1.12.2024, at about 15.30 hours, oh credible information, the sub-Inspector of poll'ce along with his staff and mediators rushed to poliput Junction, Jolaput Panchayat, Munchingiputtu, AIluri Seetharamaraju district, and found Al and A2 in possession and illegal transportation of 569 KGs of Ganja in Bolero vehicle bearing registration No.OD 10 U 5148. The police caught A2 red handed, while Al absconded from the spot. The contraband, along with crime vehicle and other material, was seized under cover of a mediators report and a case was registered against the accused. 4. Heard. Perused the record. 5. The petitioner herein was arrested on o1.12.2024 and since then he is languishing in jail for more than 206 days. Learned Assistant Public Prosecutor submits that maJ'Or POrtiOn of investigation has been completed. statutory period of 180 days is completed, but the police neither filed any charge sheet within the stipulated time nor filed any application for 'extension of time for investigation. I---.--~ 6. In view of the aforesaid facts and circumstances of the case, this Court is l'nclined to grant bail to the petitioner herein, on the following conditions. (i) The petitioner herein shall be released on bail on his executing personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-cum- Special Judge for trial of offences under the NDPS Act, Visakhapatnam. (ii) On release, the petitioner shall appear before the Station House Officer concerned once in a week i.e. on every Friday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet. 7.
