Verma and Mr. Vishal Panwar, Additional Advocates General, with Mr. Ravi Chauhan, Deputy Advocate General, for State. ____________________________________________________________ Sandeep Sharma, Judge (oral): Petitioner herein, who is working as JBT in Government Primary School, Jood, under complex GCPS Chanawag, Education Block Sunni, District Shimla, Himachal Pradesh, has approached this Court in the instant proceedings, seeking directions to respondents to consider and decide his pending representation (Annexure P-2), whereby he has prayed for inter-district transfer under 5% quota from District Shimla to District Bilaspur, on account of the fact that he has completed five years in District Shimla, in time bound manner. 2. Having regard to the nature of prayer made in the instant petition and order proposed to be passed, this Court sees no necessity to call for the reply on behalf of the respondents, who are otherwise represented by Mr. B.C. Verma, learned Additional Advocate General. Mr. 1Whether the reporters of the local papers may be allowed to see the judgment? 2 Verma fairly states that pending representation, if not already decided, shall be decided expeditiously, in accordance with law. 3. Having taken note of the fact that petitioner has already completed five years in District Shimla, coupled with the fact that notification dated 20.11.2021 (Annexure P-1), clearly provides 5% quota for inter- district transfer, subject to employee completed five years in one District, this Court sees no impediment in issuing directions to respondents to consider and decide his pending representation, in a time bound manner. 4. Consequently, in view of the above, present petition is disposed of, with the direction to respondents to consider and decide his pending representation (Annexure P-2) expeditiously, preferably, within a period of four weeks from today. Needless to say, authority concerned while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders thereupon taking note of notification dated 20.11.2021, which certainly enables an employee to seek transfer to another District, upon completion of five years in one District.
