It would suffice, if the narration in the petition would begin from representation that is given by the trust to the Backward Classes Welfare Department, for grant of certain amount in the budget for the year 2022-2023. The representation was submitted on 24.04.2022. The representation was for construction of a building, Ganigara Samudaya Bhavana, for several educational, cultural and social activities. The assessment of expenditure was at `3.5 crores. Therefore, there is approval from the Finance Department also for release of the funds, but `1.5 crores is not released. It is therefore, the petitioner - Trust is before this Court seeking a direction to release of the remainder of 1.5 crores. 5. Learned counsel appearing for the petitioner would vehemently contend that the government order dated 18.01.2023, which is projected as cancellation, is not an order of cancellation by the Finance Department or by any other department and not even by the Backward Classes Welfare Department, as the earlier order dated 18.10.2022 was restricted to `2/- crores terming it to be cancelled. He would further contend that subsequent orders passed by the Finance Department or even the Backward Class Welfare Department - 12 - NC: 2025:KHC:12764 WP No. 4321 of 2025 would clearly indicate that the petitioner - trust is entitled to the remaining funds of `1.5 crores. 6. Learned Additional Government Advocate appearing for respondent Nos.1 to 4 would refute the submissions, contending that the order dated 18.10.2022 has been withdrawn or cancelled and the amount is restricted to `2/- crores and `2/- crores is already been released. In the light of the release of `2/- crores, the petitioner would not become entitled to the remainder fund of `1.5 crores. He would contend that the Finance Department was not aware of the fact of cancellation of the grant and therefore, had given its approval at a subsequent date. He would seek to place a document on record, which is of yesterdays date i.e., 21.03.2025, when the matter is completely heard and was directed that the matter be posted for ‘dictation of orders’. He would contend that the petition may be dismissed as `2/- crores is already paid. - 13 - NC: 2025:KHC:12764 WP No. 4321 of 2025 7. I have given my anxious consideration to the submissions made by the learned counsel for the respective parties and have perused the material on record. 8. The afore-narrated facts, dates and events are not in dispute. The petitioner - trust having been granted `3.5 crores from the government, entered into an agreement for construction; when only `2/- crores was released out of `3.5 crores, the petitioner – trust is said to have submitted representation seeking release of remainder of the funds of `1.5 crores. Subsequent orders are passed by the Finance Department and even the Backward Classes Welfare Department for release of `1.5 crores. In every communication as quoted supra, what is discernible is, the remainder of `1.5 crores is directed to be released. Therefore, all the wings of the government have always thought that the amount of `3.5 crores was approved, what was paid was only `2/- and remaining `1.5 crores is yet to be paid. 9. The document that the learned Additional Government Advocate now wants to place before this Court, which is dated - 14 - NC: 2025:KHC:12764 WP No. 4321 of 2025 21.03.2025 does not inspire even a semblance of confidence as it is during the hearing or after the hearing is over, the Finance Department is seeking clarification, when the orders are passed, not once but twice. The finance department has not gone through the papers and passed the orders. It is ununderstandable as to how the Finance Department as observed hereinabove, that `1.5 crores, which is the remainder of the fund to be released to the petitioner – trust, is not yet released. 10. In the light of the subsequent communications emerging from the approvals of the Chief Minister, the Finance Department and also the Backward Classes Welfare Department, the amount is yet to be paid is what shocks the Court. Therefore, it becomes a classic case where a direction is to be issued not to consider for release of payment but to direct release of payment to the petitioner –trust of `1.5 crores, within a time frame. - 15 - NC: 2025:KHC:12764 WP No. 4321 of 2025 11. For the aforesaid reasons, the following: ORDER a. The writ petition and I.A.No.1/2025 are allowed. b. Mandamus issues to the fourth respondent – Backward Classes Welfare Department, to release the remainder of `1.5 crores to the petitioner – trust, within four weeks from the date of receipt of a copy of the order. c. In the event, the amount as aforesaid is not released, the petitioner would become entitled to an interest at the rate of 6% from the date it fell due, till the date of its payment.
