The present transfer application has been filed with the following prayer: "i. direct the opposite party no.1 to transfer the case no.PW 18 of 2017 Shri Surendra Babu and others v/s K.G.N. Construction & Distribution and others connected with file U/S 340 Cr.P.C. to the Deputy/ Additional Labour Commissioner Lucknow, 23 A.P. Sen Road Lucknow. ii. it is, therefore, humbly and respectfully prayed that this Hon'ble Court may graciously be pleased to transfer case no PW 18 of 2017 connected with file U/S 340 CrPC from Assistant Labour Commissioner Raebareli to Deputy/ Additional Labour Commissioner Lucknow." 3. Considering the fact that the applicant is a company, no material has been placed to show that the transfer of the proceedings are required particularly when the proceedings are pending under the Industrial Disputes Act, which is a welfare legislation designed to protect the rights of the of the labours. The Counsel for the applicant argues that earlier the opposite party no.3 had withdrawn the case and subsequently, an application was moved at the instance of the authorized representative Sri Arvind Singh Raothore.
