HON'BLE RAJEEV SINGH, J.
1. Heard Sri Pramod Kumar Shukla, learned counsel for the petitioner and learned A.G.A. for the State. 2. This writ petition has been filed with the following prayers :- (i) Issue a writ, order or direction in the nature of Certiorari thereby quashing the impugned FIR dated 04.07.2025 bearing Case Crime No. 0252/2025, Under Section 108 B.N.S. 2023 at Police Station Mohanlalganj, District Lucknow contained in Annexure No.1 to this writ petition. (ii) Issue a writ order or direction in the nature of Mandamus thereby commanding and directing the opposite parties no.1 to 3 not to arrest the Petitioner in pursuance to the FIR dated 04.07.2025 bearing Case Crime No. 0252/2025, Under Section 108 B.N.S. 2023 at Police Station Mohanlalganj, District Lucknow. 3. Learned counsel for the petitioner submits that the impugned F.I.R. has been lodged on the basis of false and concocted story, whereas no offence as alleged is made out against the petitioner. He also submits that the co-accused, Manju, has been granted interim protection by this Court by means of order dated 12.09.2025 passed in Criminal Misc. Writ Petition No. 7587 of 2025. Thus, the petitioner is also entitled for interim protection. 4. Learned A.G.A. has opposed the aforesaid prayer made by learned counsel for the petitioner by submitting that the allegations in Versus Counsel for Petitioner(s) : Pramod Kumar Shukla Counsel for Respondent(s) : G.A. Raksharam @ Achche Ram .....Petitioner(s) State Of U.P. Thru Principal Secretary/ Addl. Chief Secreatry, Home Deptt. And 3 Others .....Respondent(s)
the impugned F.I.R. are mainly against the petitioner, who was the bone of contention between the husband and wife on account of which the husband/deceased committed suicide. He further submits that the allegations have not been denied in the petition. Thus, the instant writ petition is misconceived and is liable to be dismissed. 5. Having considered the submissions of learned counsel for the parties and upon perusal of the contents of the impugned F.I.R., it transpires that the allegations are mainly against the petitioner, on account of which the deceased committed suicide. As per the allegations, the petitioner has interfered in the matrimonial alliance of the deceased and the co-accused and has broken the crucial fabric of marital harmony and trust.
Looking into the allegations, this Court is not inclined to exercise discretion under Article 226 of the Constitution of India. 6. Accordingly, the writ petition is dismissed.
