Mr. Ravi Bisht, Advocate for the petitioner. Mr. N.K. Papnoi, Standing Counsel for the State. 2. Petitioner is serving as Assistant Teacher (LT Grade). She was transferred from Govt. Junior High School, Kolhupani, Sahaspur, Dehradun to Govt. Junior High School, Kaitri, Kalsi, Dehradun vide order dated 15.07.2024. Petitioner has challenged her transfer in this petition. 3. Coordinate bench passed interim order in favour of petitioner on 22.07.2024, pursuant to which, petitioner is still serving at the place she was earlier posted. 4. Learned counsel for the petitioner submits that petitioner has now completed 55 years of age, therefore she comes under the category of “senior employee”. It is thus submitted that petitioner cannot now be transferred. 5. Learned State Counsel, however, submits otherwise and contends that petitioner can still be transferred. Be that as it may, this Court is not inclined to go into the merits of the matter. 6. The writ petition is, accordingly, disposed 2025:UHC:11316 of with liberty to petitioner to make representation to the competent authority against her transfer. If she makes representation within two weeks from today, decision thereupon shall be taken within six weeks thereafter. 7. For a period of eight weeks or till decision is taken on representation, whichever is earlier, status quo, as regards petitioner’s posting shall be maintained. 8. However, it is made clear that if petitioner fails to make representation within stipulated time, petitioner shall not be entitled to any protection of this order.
