Jai Karan (deceased) through LRs. vs. Aman Kumar CMP(M) No.1379 of 2023 and CMP(M) No.1380 of 2023 in RSA No.4221 of 2013 10.03.2025 Present: Mr. Naveen K. Bhardwaj, Advocate, for the applicants- proposed legal heir of deceased appellant. Mr. Jai Ram Sharma, Advocate, for the respondent. CMP(M) No.1379 of 2023 and CMP(M) No.1380 of 2023 The sole appellant, in the case at hand, has died on 11.01.2018, as is evident from the Death Certificate appended along-with the application (CMP(M) No.1379 of 2023). As per Death Certificate, the appellant is survived by his legal heirs. The same is in consonance with the details of the legal heirs given in Paragraph-3 of the application (CMP(M) No.1379 of 2023). Since the right to sue inheres/survives with the aforesaid legal heirs of deceased sole appellant, therefore, they are ordered to be brought on record. For the bona fide reasons stated/sufficient cause shown in the application, delay in bringing on record the legal heirs of sole deceased appellant, is condoned and abatement, if any, is set aside.
