HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 9197 of 2025 Court No. - 10 HON'BLE RAJNISH KUMAR, J.
HON'BLE ZAFEER AHMAD, J.
1. Heard Sri Dev Mani Mishra, learned counsel for the petitioners and learned A.G.A. for the State.
2. This petition has been filed seeking following main relief:-
"(I) issue a writ, order or direction in the nature of certiorari quashing the impugned F.I.R. dated 15.09.2025, bearing F.I.R. No.0210 of 2025, u/s 191(2), 191(3), 190, 115(2), 352, 351(3), 109(1), 110, 333 B.N.S., 2023, Police Station Jethwara, District Pratapgarh, as contained in Annexure No.1 to the writ petition."
3. Learned counsel for the petitioners submits that the impugned FIR has been lodged against the petitioners on the basis of wrong and concocted story whereas the petitioners' side had suffered injuries in the alleged incident and the FIR of the petitioners has not been lodged by the concerned police station.
4. Learned A.G.A. opposes the submissions of learned counsel for the petitioners and submits that there are injuries also and injured Vimal and Poonam have suffered serious injuries and they are still hospitalized, therefore, contentions of learned counsel for the petitioners are misconceived.
5. Having considered the submissions of learned counsel for the parties and on perusal of record, commissioning of offence cannot be ruled out as Versus Counsel for Petitioner(s) : Dev Mani Mishra Counsel for Respondent(s) : G.A. Ram Kripal And Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Others .....Respondent(s)
the incident itself is not denied by the petitioners, as it has been alleged that the petitioners have also suffered the injuries. Thus, the injuries are to both the sides. The plea and material of the petitioners, if any, cannot be considered at this stage by this Court.
6. In view of above, the present petition lacks merit and is accordingly dismissed. October 7, 2025 Saurabh CRLP No. 9197 of 2025 2 (Zafeer Ahmad,J.) (Rajnish Kumar,J.) Digitally signed by :- SAURABH VERMA High Court of Judicature at Allahabad, Lucknow Bench
