Justice Rajani Dubey, J Order on Board 28/04/2025 Challenge in this appeal is to the judgment of conviction and order of sentence dated 28th June, 2007 passed by IV Additional Sessions Judge (FTC), Raigarh in Sessions Trial No.12/2006 2 convicting the appellant under Section 376 of IPC and sentencing him to undergo RI for 7 years, pay a fine of Rs.500/- and in default thereof to suffer additional RI for 2 months. 02. Learned counsel for the appellant submits that the sole appellant in this case has died on 19.4.2016. He has filed certified copy of death certificate of the appellant. No application for prosecuting this appeal has been filed by the legal heirs/representatives of the deceased appellant. 03. Learned counsel for the respondent/State does not dispute the above fact. 04. In view of above, the instant appeal stands abated and is dismissed as such.
