Heard learned counsel for the revisionist and learned AGA for the State of U.P. as well as perused the record. 2. By means of instant revision, the revisionist has challenged/impeached the order dated 28.08.2025 passed by the Principal Judge, Family Court, Unnao (in short "Family Court") in Criminal Misc. Case No. 361 of 2020 (Smt. Saloni and another vs. Pravesh Kumar Sharma), instituted on 23.06.2020 in terms of Section 125 Cr.P.C. 3. It is to be noted that vide order dated 28.08.2025, the Family Court has awarded Rs. 1000/- per month to the opposite party No. 2/Smt. Saloni and Rs. 1000/- per month to the opposite party No. 3/Shivank (son of revisionist) towards maintenance from the date of preferring the application under Section 125 Cr.P.C. i.e. 23.06.2020 to the date of final order i.e. 28.08.2025 and also awarded her Rs. 4000/- per month to the opposite party No. 2/Smt. Saloni and Rs. 2000/- per month to the opposite party No. 3/Shivank (son of revisionist) till the age of majority towards maintenance from the date of final order dated 28.08.2025. The operative portion of the order dated 28.08.2025 reads as under:- "उपरोक्तानुसार प्रािथया का भरण पोषण प्राथर्नापत्र स्वीकार िकया जाता है। िवपक्षी को िनदेर्िशत िकया जाता है िक वह प्रािथया श्रीमती सलोनी तथा उसके अवयस्क पुत्र िशवांक प्रत्येक को भरण पोषण हेतु प्राथर्ना पत्र प्रस्तुत करने की िदनांक 23.06.2020 से िनणर्य की िदनांक तक (रजनेश बनाम नेहा के अनुपालन में) प्रत्येक को 1000-1000/- (एक-एक हजार) रुपये प्रितमाह अदा करे तथा िनणर्य की िदनांक से भिवष्य में प्रािथया श्रीमती सलोनी को 4000/- (चार हजार) रुपये प्रितमाह भरण पोषण एवं उसके अवयस्क पुत्र िशवांक (उसके वयस्क होने तक) को 2000/- (दो हजार) रुपये प्रितमाह भरण पोषण अंग्रेजी माह के प्रथम सप्ताह में अदा करे। पूवर् में यिद कोई अन्तिरम भरण पोषण िदया गया है तो वह उपरोक्त धनरािश में समायोिजत िकया जाएगा। तदोपरान्त यह पत्रावली िनयमानुसार दािखल दफ्तर हो।" 4. Taking note of the aforesaid meagre amount awarded by the Family Court to the Versus Counsel for Revisionist(s) : Farooq Ayoob, Km. Pooja Tiwari Counsel for Opposite Party(s) : G.A. Pravesh Kumar Sharma .....Revisionist(s) State Of U.P. Thru. Prin. Secy. Home Lko. And 2 Others .....Opposite Party(s) opposite party Nos. 2 and 3 vide order under challenge dated 28.08.2025 and also the findings recorded by the Family Court, as per which under compelling circumstances on account of ill-treatment by the revisionist the opposite party No. 2 alongwith minor was compelled to live separately and also various pronouncements on the subject including passed in the case(s) of Anju Garg and another vs. Deepak Kumar Garg, 2022 SCC OnLine SC 1314; Sanjeev Kapoor vs. Chandana Kapoor and others, (2020) 13 SCC 172; Chander Parkash Bodh Raj vs. Shila Rani Chander Prakash, 1968 SCC Online Del 52; Rajnesh vs. Neha, (2021) 2 SCC 324 : (2021) 2 SCC (Civ) 220 : 2020 SCC OnLine SC 903 at page 347; Kulbhushan Kumar Vs. Raj Kumari, (1970) 3 SCC 129; Kalyan Dey Chaudhary Vs. Rita Dey Chaudhary Nee Nandy, (2017) 14 SCC 200, this Court finds that the instant revision is liable to be dismissed.
