Criminal Miscellaneous II Bail Application No. 5540/2025 Ramesh S/o Shri Bhuralal, Aged About 36 Years, R/o Hanuman Mandir Ke Pass, Talab Gaon, P.S. Anantpura, District Kota, At Present Sanjay Nagar, P.S. Vigyan Nagar, Kota (Raj.) (Accused At Present Confined In Central Jail Kota). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Samarth Sharma For Respondent(s) : Mr. Onkar Singh Rajpurohit, P.P.
HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI
Order 27/05/2025 The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioner in the matter arising out of F.I.R. No. 04/2022, registered at Police Station Raanpur, District Kota City (Rajasthan), for the offence(s) punishable under Section(s) 323, 341, 143 & 451 I.P.C.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he has nothing to do with the alleged offences and he is behind the bars since 08.08.2022. The other co-accused persons, namely Mangilal, Dilip, Raju & Ravi, have already been granted bail by this Court. Learned counsel further submits that the statements of material witnesses have been recorded before the learned Trial Court and there are contradictions in their statements. Trial of the case is likely to take
[2025:RJ-JP:22221] (2 of 2) [CRLMB-5540/2025] a long time to conclude. Till then his further incarceration would not serve any fruitful purpose and he is ready & willing to furnish his bail bonds. Therefore, the bail application deserves to be allowed. Learned Public Prosecutor has vehemently opposed the bail application. Heard learned counsel for the parties and perused the material available on record. Considering the overall facts & circumstances of the case more particularly the fact that other co-accused persons have already been enlarged on regular bail and considering the
submissions made by learned counsel at bar but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioner on bail. Therefore, the 2nd bail application is allowed. Accused- petitioner namely Ramesh S/o Shri Bhuralal, shall be released on bail, if he is not required in any other case, provided he furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when he is called upon to do so.
