HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11411 of 2025 Court No. - 30 HON'BLE MANJIVE SHUKLA, J. 1.Heard Sri Afzal Hasan, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
2. The instant writ petition has been filed challenging therein, the order dated 02.09.2025 passed by the District Panchayat Raj Officer, Bahraich whereby, the petitioner, who is working as Village Panchayat Officer, has been transferred from Block Risiya to Block Shivpur.
3. Learned counsel appearing for the petitioner has argued that petitioner was posted in Block Risiya vide order dated 23.08.2025 and only after few days, the impugned
order of transfer had been passed and he had been directed to join in another development block.
4. Learned Standing Counsel appearing for the respondents has pointed out that the
order dated 23.08.2025 is not the transfer order rather petitioner's suspension was revoked and therefore he was reinstated on his original post in Block Risiya, and thereafter vide impugned order dated 23.08.2025, he had been transferred from Block Risiya to Block Shivpur.
5. Learned Standing Counsel appearing for the respondents has vehemently argued that the petitioner has been shifted only from one Block to another Block in the same District and further petitioner is holding a transferable post therefore is liable to be transferred from one place to another as per the exigency of work and it is the domain of the executive authorities to transfer government servants from one place to another, as such, there is no illegality in the impugned order dated 23.08.2025.
6. I have considered the arguments advanced by the learned counsels appearing for the parties and I find that the petitioner has been transferred from one Block to another Block in the same District. I further find that it is in the domain of the executive authorities to transfer government servants from once place to another. Versus Counsel for Petitioner(s) : Afzal Hasan Counsel for Respondent(s) : C.S.C. Saiyed Shuaib Ahmad .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Panchayati Raj Deptt. Lko. And 3 Others .....Respondent(s)
7. Unless it is shown that the transfer order has been passed in violation of any statutory rule or, on its face, is arbitrary, it is not open for this Court to interfere with the order of transfer.
8. Having considered the facts and circumstances of the case, I do not find any illegality or infirmity in the impugned transfer order dated 02.09.2025.
9. Accordingly, this writ petition lacks merit and is hereby dismissed. September 24, 2025 Shahnaz WRIA No. 11411 of 2025 2 (Manjive Shukla,J.) Digitally signed by :- SHAHNAZ BANO High Court of Judicature at Allahabad, Lucknow Bench
