Criminal Miscellaneous Bail Application No. 5544/2025 Sachin S/o Durgesh, Aged About 27 Years, R/o Near Old Chambal Pul, Burpura, Police Station Kotwali, Dholpur- Raj. (At Present Confined In District Jail Dholpur). ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Mohammad Shahid Hassan For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 14/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.571/2023 registered at Police Station-Kotwali Dholpur, District-Dholpur for the offences under Sections 147, 148, 149, 341, 323, 504, 452, 307 and 302 of IPC. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Counsel further submits that the other co-accused-Satish Giri has been released on bail by Coordinate Bench of this Court. He further submits that the case of the present petitioner is akin to that of other co-accused. Petitioner is behind the bars since 14.01.2024. Charge-sheet has been filed. The trial of the case may take considerable time, [2025:RJ-JP:26075] (2 of 2) [CRLMB-5544/2025] therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has opposed the bail application and submitted that the name of the present petitioner is specifically mentioned in the FIR and in the statement recorded during the investigation. He further submits that petitioner is facing charge of murder of deceased Sheela and therefore, considering the gravity of offence, petitioner is not entitled for bail. He further submits that the name of other co-accused-Satish Giri was not mentioned in the FIR, therefore, Coordinate Bench of this Court has granted benefit of the bail to the petitioner. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the fact that name of present petitioner was mentioned in the FIR as well as statement recorded during investigation but without expressing any opinion on the merits/demerits of the case, I am not inclined to allow the present bail application filed by the petitioner. 6. Hence, the present bail application is hereby dismissed. (PRAMIL KUMAR MATHUR),J Arun/99
