Heard Sri Ravindra Kumar Singh, the learned counsel for the applicant, Sri Jayant Singh Tomar, the learned A.G.A.-I appearing on behalf of the State and perused the records. 2. By means of the instant application the applicant has prayed for transfer of Case No.8055 of 2024: State of Aman and others, arising out of Case Crime No.299 of 2024, under Sections 498-A, 323, 504, 506 I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Deva, District Barabanki from the court of learned Chief Judicial Magistrate Court No.17, Barabanki to the competent court at Lucknow. 3. The aforesaid case was instituted on the basis of an F.I.R. lodged by the applicant herself in Police Station Deva, District Barabanki against her husband and husband's family member stating that all the accused persons used to harass her for demanding dowry. 4. Now the applicant is seeking transfer of the criminal proceedings instituted by her at District Barabanki to Lucknow merely on the ground that she is residing at Lucknow. 5. The place of residence of the applicant is not relevant for Versus Counsel for Applicant(s) : Ravindra Kumar Singh Counsel for Opposite Party(s) : G.A. Smt. As the applicant herself has lodged the F.I.R. in District Barabanki, the criminal proceedings instituted on the basis of the aforesaid F.I.R. lodged by the applicant in District Barabanki merely on the ground of place of residence of applicant in District Lucknow, there is no ground for transfer of the proceedings. 7.
