Heard learned counsel for the petitioners and learned A.G.A. for the State. This writ petition has been filed by the petitioners for the following prayers :- (i) Issue a Direction, Order or Writ in the nature of CERTIORARI quashing thereby impugned First Information Report (in brief FIR) No. 0263 of 2025, Dated 11.08.2025 Under Sections 131, 352, 351(3) BNS lodged at P.S. Payagpur, District-Bahraich, Uttar Pradesh, i.e. Annexure No. 1, to this Writ Petition. (ii) Issue a Direction, Order or Writ in the nature of MANDAMUS commanding thereby to opposite party no. 2 and 3 not to arrest the petitioners in respect of aforesaid F.I.R. till the pendency of this Writ Petition. The learned A.G.A. has produced before this Court the instructions dated 25.09.2025, sent by Rajdev, Sub-Inspector, Police Station Payagpur, District- Bahraich, which are taken on record. He, on the basis of said instructions submits that in the present case charge sheet dated 29.07.2025 has been prepared and submitted to the Court of Judicial Magistrate, Bahraich on 17.09.2025. In view of the above, learned counsel for the petitioners submits that he does not want to press the present petition and prays that the same may be dismissed as not pressed with liberty to avail appropriate remedy. To which there is no objection by the other side. Accordingly, the petition is dismissed as not pressed with aforesaid liberty.
