Learned counsel for the respondent -authorities submits that the categorization of the houses is made depending upon the documents furnished by the petitioners. Referring to the same, counsel for the respondent-authorities submits that if petitioners had furnished the documents evidencing the fact that the petitioners have been residing within the land forming part of the 1st category, one year prior to the issuance of the preliminary notification, the case would be considered under the 1st category. However the documents furnished by the petitioners as seen at Annexures-B to B6 would indicate that the same are within the period of one year from the date of issuance of the Notification. 4. At this juncture counsel for the petitioners submits that liberty be reserved to the petitioner to furnish further documents and a direction in this regard be issued - 5 - NC: 2025:KHC:1940 WP No. 28460 of 2018 to the respondent -authorities to re-consider the case of the petitioners. 5. In response, counsel for the respondent- authorities submits if the documents are furnished by the petitioner regarding they residing in the land one year prior to the issuance of preliminary Notification the same would be considered in accordance with law. 6. In that view of the matter, following; ORDER (a) Petition is disposed of. The impugned order at Annexure-A is kept in abeyance. (b) Petitioners are at liberty to furnish documents and other details if any evidencing the fact of they having been residing in the land prior to issuance preliminary notification. (c) On receipt of the same, respondent -authorities shall after heaving the petitioner, shall pass an appropriate and considered order in accordance with law, within an outer limit of three (3) - 6 - NC: 2025:KHC:1940 WP No. 28460 of 2018 months from the date of receipt of certified copy of this order.
