ORDER 28-07-2025 Heard Mr. M. H. Laskar, learned counsel for the petitioners. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor, for the State respondent. This is application under Section 482 BNSS, 2023 praying for grant of pre- arrest bail to the accused/petitioners, who are apprehending arrest in connection with Silchar P.S. Case No.1300/2022, under Sections 406/468/420 IPC. It is submitted by Mr.
Laskar, learned counsel that the present petitioners after obtaining interim pre-arrest bail on 20.08.2024, they accordingly appeared
Page No.# 4/5 before the I.O. of the case and their statements were already recorded and since 05.12.2024 the case is pending for case diary, but till date, the I.O. could not furnish the case diary inspite of repeated reminders. He further submitted that the case is of civil in nature and the documents were already collected by the I.O. and they are still ready and willing to cooperate with the I.O. for further investigation of the case, if they are granted with the privilege of pre-arrest bail. Mr. Borthakur, learned Additional Public Prosecutor submitted that case diary was earlier received but as the statements of the petitioners were not available in the case diary, the up-to-date case diary was called for, however, the I.O. could not furnish the up-to-date case diary till date. Mr. Borthakur accordingly submitted that there are some serious allegations of forgery and hence the case diary may be necessary for the disposal of this bail application. Considering the submissions of the learned counsel for the both sides and on perusal of the case record, it is seen that the case is civil in nature though there are some allegations of forgery of the documents, but it is seen that after a lapse of near about 1(one) year, the I.O. has failed to produce the updated case diary. In view of this, I find that the order of interim pre-arrest bail dated 20.08.2024 may be made absolute with the same terms and conditions and further, the petitioners are directed to appear before the I.O. and co-operate with the further investigation of the case as well as their statements may also be recorded, if it is required for the purpose of investigation of the case.
Accordingly, the interim pre-arrest bail dated 20.08.2024 is hereby made
