Th'ls Criminal Petition 'IS filed under Section 438 of the Code of Cr-lminal procedure, seeking anticipatory ba" for the petitioners, who are arraigned as Accused Nos.4 and 5 -ln Crime No.61 of 2024, on the file Of lndukurPet Police station, sri potti sriramulu Nellore District, under Sect'lon 324 r/w Section 34 of the lnd'lan penal Code. 2. lt 'lS Submitted that although the Crime Was in'ltially registered under section 324 lPC, the POliCe have Subsequently altered the Offence tO Section 326 lPC upon receipt Of the WOund Certificate, Which ind'lCateS a fracture injury sustained by the de-facto complainant's father. 3. The learned COunSe[ for the Petitioners COntendS that the allegations aga'lnst the petitioners do not attract the prov|lsions of section 326 lPC, as Per the complaint. Furthermore, it iS Submitted that the Pet-ltiOnerS are women, and pet'lt-loner No.2/Accused No.5's husband iS also a CO-accused in the Case. The allegations punishable under sectlon 326 lPC cannot be made Out the Case Of the petitioners as seen from the complaint. 4. The learned Assistant Public Prosecutor appearing for the State submits that the provisions of law have been altered after the receipt of the wound certificate, which indicates that the de-facto complainant's father has suffered a fracture injury. Considering the case and between the petitioners and the de-facto complainant in crime No.61 of 2024 the petitioners shall be enlarged on bail in the event of their arrest, subject to the following condition:- i) The petitioners shall be enlarged on bail in the event of their arrest upon furnishing a personal bond for Rs.10,000/-(Rupees Ten Thousand only), along with two sureties for a like sum each, to the sail-sfaction of the lndukurpet Police Station, Sri Potti Sriramulu Nellore District. ii) The petitioner shall cooperate with the investigation and appear before the Station House Officer, as and when required. 6. With the above conditions, the criminal petition is allowed.
