IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.3401 of 2025 ------ Suraj Singh, son of late Munna Singh, resident of Kailash Nagar, Chas, PO and PS Chas, District Bokaro, Jharkhand … … Petitioner(s) Versus The State of Jharkhand. … … Opposite Party(s) ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sanjay Kumar, Advocate. For the State : Mr. Rakesh Kumar Sinha, A.P.P. ----- 03/ 25.06.2025 Heard the parties. 2. This anticipatory bail application under Sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 127(2), 351(2)(3)/85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The prosecution case in brief is that the victim while going to her college met with the petitioner on whose request she boarded on his car who gave her milk shake to drink and after drinking it she fell unconscious, then this petitioner along with another tried to outrage her modesty and made her video. Thereafter the petitioner put vermilion on the head of the victim. After few days he forced the victim to marry him and out of fear she went to the office of Marriage Registrar and signed the documents. Thereafter, the petitioner forced her to bring ATM and ornaments of her mother on which she tried to commit suicide in cooling pond. 4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. After hearing the parties, I find that both the victim and the petitioner are major. There is a marriage certificate also. The manner in which the occurrence had taken place creates a doubt in the mind of this Court about the current prosecution story as narrated in the prosecution case further this case has

been lodged after about one year of the occurrence. It is also surprising if the marriage was registered by force or by deception or threat, then why the girl did not inform the Registrar who has registered the same. 6. Considering the aforesaid fact, this Court finds it a fit case for grant of anticipatory bail to the petitioner. 7. Accordingly, this Anticipatory Bail Application stands allowed.
The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class-cum-Civil Judge, Jr. Div., Bokaro, in connection with City Mahila P.S. Case No. 4 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
