Jyotsna Rewal Dua , J With the consent of learned counsel for the parties, the matter is heard at this stage. 2. Following order was passed in the matter on 06.06.2025 granting interim stay to the petitioner-Panchayat Secretary against his transfer from Gram Panchayat Khiliyana, Development Block Nalagarh to Gram Panchayat Bhogpur, Development Block Nalagarh: - “Notice. Mr. L.N. Sharma, learned Additional Advocate General and Mr. Rajesh Prakash, learned counsel, appear and waive service of notice on behalf of respondents No.1, 2 & 4 and respondent No.3, respectively. 1 Whether reporters of the local papers may be allowed to see the judgment? yes 2 2. Petitioner is presently serving as Panchayat Secretary at Gram Panchayat Khiliyan, Development Block Nalagarh. His grievance is to the office order dated 30.05.2025 (Annexure P-1), whereunder he has been transferred to Gram Panchayat Bhogpur, Development Block Nalagarh. The ground for challenging the aforesaid transfer order is that the petitioner has not as yet completed his normal tenure at the present place of posting. That he will complete three years tenure on 11.10.2025. 3. In view of above, operation of the impugned office order dated 30.05.2025 (Annexure P-1) shall remain stayed qua the petitioner. 4. Let learned Additional Advocate General to have instructions about letting the petitioner to continue to serve at his present place till the completion of normal tenure of three years by the next date of hearing. List on 03.07.2025. Reply by the appearing respondents be filed in the meanwhile.” 3. Interim relief was granted to the petitioner on the ground that he had not completed three years of tenure at his present place of posting and that he would complete the normal tenure of three years on 11.10.2025. The respondents have not filed the reply. 4. In view of the limited grievance of the petitioner, this writ petition is disposed of by making the interim order dated 06.06.2025 absolute with liberty to the respondents/competent authority to consider the case of the petitioner for transfer after 11.10.2025 on his completing normal tenure of three years at his present place. 3 Pending miscellaneous application(s), if any, shall also stand disposed of.
