Petitioners are aggrieved by the police excesses and complain that on the garb of certain jewelleries and laptops retained, the police authorities are harassing the petitioners. There is no specific case and each and every date the petitioners are being called by the police authorities, as such the petitioners feel they are being harassed and humiliated by the police agency. State has submitted a report. Report encloses the documents, the police authorities have served notice in respect of the information furnished by the private respondents wherein it is claimed that there are dues of huge amount which the petitioners from time to time had taken from the private respondents. Such information furnished with the police authorities are being enquired into by the officers of Baranagar Police Station and their superior officers. 2 Having considered that the police authorities are conducting an enquiry and yet to register any specific criminal case, I am of the view that pursuant to the judgment of Lalita Kumari –Vs. – Government of Uttar Pradesh & Ors. reported in (2008) 14 SCC 337, the police authorities are exercising their powers within the domain of law. As such no interference is called for in respect of the accusations made in the writ petition. If the petitioners are aggrieved by the action of the police authorities they would be at liberty to approach the jurisdictional Court. No interference is called for to invoke the jurisdiction under Article 226 of the Constitution of India. Accordingly, WPA 6912 of 2025 is disposed of. Report so submitted by the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
